Terms of Service

Welcome to Cocoon Modern. These Terms of Service govern your use of cocoonmodern.com (the “Site”) and any purchase you make through it. By using the Site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to purchase from the Site. If you are under 18, a parent or legal guardian must place the order on your behalf.

2. Account & Order Accuracy

You agree to provide accurate, current, and complete information for any account, shipping address, and payment method. You are responsible for keeping your account credentials secure. We may refuse or cancel orders for any reason, including suspected fraud, pricing errors, or stock issues.

3. Pricing & Payment

All prices are shown in U.S. dollars. We may update prices at any time without notice. The price you pay is the price shown at checkout. Payment is processed at order placement; for made-to-order fabrics (Belgian Linen and Velvet) production does not start until payment clears.

4. Made-to-Order Items

Items in Belgian Linen and Velvet are cut and upholstered specifically for your order. Lead times are listed on each product page and in our Shipping page. We cannot guarantee dye-lot consistency across separate orders.

5. Shipping & Risk of Loss

Title and risk of loss pass to you when the delivery is signed for. Inspect your delivery on receipt. See our Shipping page for full details.

6. Returns

Returns are governed by our Refund Policy. A 15% restocking fee applies to Belgian Linen and Velvet returns because the fabric is non-resellable.

7. Warranty

Our furniture is covered by a 5-year warranty on the frame against manufacturing defects, and a 1-year warranty on fabric and finish. The warranty does not cover normal wear, accidental damage, or improper care. Contact hello@cocoonmodern.com to file a warranty claim.

8. Intellectual Property

All content on the Site — including product photography, copy, the Cocoon Modern name, and the Cocoon Modern logo — is owned by Cocoon Modern or its licensors and may not be copied or reused without written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Cocoon Modern is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or the products. Our total liability for any claim related to a product is limited to the amount you paid for that product.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflicts of law principles. Any dispute will be resolved in the state or federal courts located in Delaware.

11. Changes

We may update these Terms from time to time. The current version will always be posted on the Site. Continued use of the Site after changes means you accept the updated Terms.
